Terms of Service & Sales (CGV/CGU)
Last updated: November 3, 2026 • Effective for any subscription ordered through RXCORP.
1. Scope & Purpose
These Terms of Service and General Conditions of Sale (hereinafter "Terms") govern the contractual relationship between the French sole proprietorship RXCORP (SIRET: 102 767 050 00010, registered in Clermont-Ferrand, France) and any individual or legal entity (hereinafter the "Customer") purchasing a game server hosting service via the Paymenter platform (https://billing.rxcorp.me).
Placing an order implies full, unreserved acceptance of these Terms.
2. Orders & Instant Automated Provisioning
All orders are processed online via our Paymenter billing portal.
- Order Confirmation: The contract is finalized upon payment validation by our secure payment gateways (Stripe or PayPal).
- Instant Provisioning: The server container is automatically provisioned and deployed on the Pelican management console within 60 seconds after payment confirmation.
- Credentials Delivery: Connection credentials (IP address, assigned ports, SFTP details) are displayed immediately on the client area and sent via email.
3. Pricing & Tax Scheme
Prices applicable are those displayed on the website and billing portal at the time of purchase.
Tax status: RXCORP operates under the French small business VAT franchise scheme. Prices are net of VAT: "VAT not applicable, art. 293 B of the French General Tax Code (CGI)".
Payments are processed securely via Stripe (Credit/Debit Card) or PayPal. RXCORP does not store complete banking or card numbers on its servers.
4. Term, Renewal & 1-Click Cancellation
All hosting plans are sold with no long-term commitment.
- Monthly Renewal: Unless cancelled by the Customer, subscriptions renew automatically each month. Invoices are generated prior to the due date.
- 1-Click Cancellation: The Customer may cancel their plan at any time directly through their Paymenter Client Area. The service will remain operational until the end of the current billing cycle, with no penalties or cancellation fees.
5. Statutory Right of Withdrawal & Digital Waiver
In accordance with Article L.221-28 13° of the French Consumer Code and EU Consumer Rights Directives, the 14-day statutory right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium where the performance has begun with the consumer's prior express consent and acknowledgment that they thereby lose their right of withdrawal.
Immediate execution: By completing checkout to benefit from instant automated server provisioning in under 60 seconds, the Customer expressly requests immediate commencement of the service and expressly waives their 14-day right of withdrawal.
In addition, RXCORP provides a transparent 48-hour commercial guarantee governed by our Refund Policy in case of verifiable hardware or network incidents not resolved by support.
6. Acceptable Use Policy & Prohibited Content
The Customer is solely responsible for files, configurations, scripts, and mods installed inside their server container.
Strictly forbidden activities leading to immediate termination without refund:
- Network attack activities (DDoS, port scanning, botnets, malware distribution, phishing).
- Cryptocurrency mining or sustained abusive CPU spikes aimed at monopolizing shared node threads.
- Hosting illegal, terrorist, hateful, or child abuse material.
- Deliberate infringement of third-party game EULAs (Mojang EULA, Cfx.re Terms of Service).
7. Non-Payment, Suspension & Data Retention
In the event of an overdue invoice:
- The server instance is temporarily suspended upon expiration.
- Container data, configurations, and backups are retained for a grace period of 7 days.
- After 7 calendar days without payment, all container data and backups are permanently and irretrievably purged.
8. Service Availability & Limitation of Liability
RXCORP exercises all reasonable care (obligation of means) to maintain high network availability and physical bare-metal hardware health.
RXCORP cannot be held liable for disruptions resulting from external carrier failures, force majeure, or crashes induced by buggy mods/plugins configured by the Customer.
Live infrastructure status and maintenance windows are publicly reported at https://status.rxcorp.me.
9. Backups & SFTP Responsibility
Automated backup features are provided inside Pelican console. While automated snapshots are scheduled, the Customer remains responsible for keeping regular off-site local copies of critical server configurations using SFTP.
10. Dispute Resolution & Consumer Mediation
For any issue, the Customer is invited to first reach out to our support via a ticket on the billing portal or via email at [email protected].
Pursuant to Article L.612-1 of the French Consumer Code, if no amicable resolution is reached within 30 days, consumers will have the right to free recourse to an accredited consumer mediator. The formal registration process is currently underway and ombudsman details will be posted on this page. Inquiries may be sent to [email protected], and the EU Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr.
11. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of France. Failing amicable resolution or mediation, any dispute shall be submitted to the competent courts of Clermont-Ferrand, France.
